These works are in the public domain, meaning that no individual creator can claim ownership. Just like other things with intellectual property, Public Domain has its exceptions, but generally speaking works can enter the public domain in several ways. Some common ones are:
- the copyright expired (this happens 70 years after the death of the creator or 95 years after publication if the creator is a corporation), or the owner has not renewed the copyright
- the work isn’t in a fixed, recorded form
- the copyright owner purposely places a work in the public domain through a “dedication”
- the work isn’t protected under copyright law
Despite the lack of copyright protections for works in the public domain, just like CC-licensed works, you still need to cite your Public Domain sources so that people will have a reference to the original material. This gives your work its space in the scholarly conversation and shows that you are using information ethically.
